The team at Attaxion (“we”, “our” or “us”) values your privacy, and we appreciate that many of your interactions with Attaxion products and services on attaxion.com (the “Site”) (collectively with the Site, “Attaxion”) involve sensitive data, including personally identifiable information (“Personal Information”). We are committed to being transparent about our privacy practices. This privacy policy broadly describes the Personal Information we collect and what we do with this data. When you use Attaxion, you’re consenting to the collection and use of your information as described in this privacy policy, so please make sure you review its terms carefully.

This privacy policy doesn’t apply to the practices of third parties (“Third Party Services”) that you opt to access through Attaxion. While we try to facilitate access only to those Third Party Services that share our respect for your privacy, we are in no way responsible for Third Party Services and encourage you to carefully review the privacy policies of any Third Party Services you access.

What Information Do We Collect?

When you use Attaxion, we may collect information about you and your actions on the Site. This includes:

  1. Your IP address: we automatically receive and record information from your web browser when you interact with Attaxion, including your IP address. This information is used to prevent abuse and also to facilitate collection of data concerning your interaction with Attaxion (e.g., what links you have clicked on). We may collect some device-specific information if you access Attaxion using a mobile device. Device information may include but is not limited to unique device identifiers, network information, and hardware model, as well as information about how the device interacts with Attaxion.
  2. Personal Information: by creating an Account and providing Personal Information to us, such as the name and contact information you provide when you establish an Attaxion account (“Account”), you allow us to identify you and therefore may not be anonymous.
  3. Credentials: when users are required to login to gain access to a particular Website feature or Web Portal, we collect usernames, passwords, and other login credentials to authenticate access to the feature or Offering.
  4. Logs of your search queries and other interactions with our servers: all content submitted by you to Attaxion may be retained by us indefinitely. Please note that if you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account but may remain stored on our servers. We may continue to disclose such content to third parties in a manner that does not reveal Personal Information, as described in this privacy policy.
  5. Cookies: When you use the Site, we set a first-party cookie to uniquely identify your browser software over time on our site, and this cookie is recorded in our logs. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend that you leave cookies active; turning off the cookie feature may stop you from using some Attaxion products and services. This privacy policy covers our use of cookies only and does not cover the use of cookies by third parties. We don’t control when or how third parties place cookies on your computer. For example, third party websites to which a link on the Site points may set cookies on your computer.
  6. Email communications: We may receive a confirmation when you open an email from us. We use this confirmation to improve our service. 
  7. Location information: Some of our Services may include features based on users’ actual locations and may report on users’ current locations (“Location-Based Services”). To the extent you voluntarily opt to use any Location-Based Services, we may collect and store information about your location at the time you use those Location-Based Services. This information can come from a variety of sources depending on the client you use to access the Services; for example, a mobile phone may report its GPS location at the time Location-Based Services are used.

In addition, we use third-party service providers and hosting providers who collect data on our behalf:

  1. We use a variety of third-party analytics services, including, but not limited to Hubspot and Google Analytics, to measure user engagement with our products. These services record data about how you use our services, and Hubspot reports to us when you open messages we send.
  2. We use Google Cloud to host parts of our servers. Google Cloud maintains additional logs of your computer’s interaction with its servers.
  3. We use Stripe and Paypal to process payments. However, we do not receive your credit card information; use and storage of that information is governed by Stripe’s terms of service and privacy policy located at https://stripe.com/us/checkout/legal and Paypal’s terms of service and privacy policy located at https://www.paypal.com/us/legalhub/home.

Your interactions with these third-party service providers will be governed by their privacy policies. Your participation and interaction with Attaxion on third-party social media sites will be governed by the relevant vendors’ privacy policies.

Where Do We Collect 

Our Site provides Internet-based access for users to learn about Attaxion and its offerings and to communicate with Attaxion and with others. When an individual, partner, or reseller, uses our Site, Attaxion gathers information, some of which may be considered personal information in your jurisdiction and is used consistent with the below purposes.

Business Contact Information – If you register to attend a Attaxion-hosted in-person or virtual event, download one of our digital materials, sign up for a Free Trial or visit our office, we will receive personal information about you, including your name, phone number, business email address, company name, and country. We use this information consistent with the purpose for which you provided it, such as to contact you about Attaxion’s offerings, company news, updates, and other Attaxion related information. We may also associate personal information that you submit to us, including email addresses, with information collected about you through other means such as cookies, web beacons, or social media plugins. This will help us better tailor content delivered to you through a variety of ways, including online advertisements. We include unsubscribe instructions at the bottom of each email if at any time you would like to unsubscribe from receiving future emails.

Audio, Electronic, or Visual Information – If you attend a Attaxion hosted in-person or virtual event or agree to be recorded in a telephone or virtual meeting, we may record some or all of that event or meeting. We may document the event in various ways, such as by taking photos at the event, interviewing you at the event, or recording your participation in a live question-and-answer or other interactive session. We use this information for business and marketing purposes, including to enhance our offerings and your customer or user experience.

Links to Other Websites – Our Site includes links to other websites whose privacy practices may differ from those of Attaxion. If you submit personal information to any of those sites or services, your information is governed by their privacy notices. We encourage you to carefully read the privacy notice of any website service you visit.

From time to time, we may receive personal information about you, including your name, email address, or other information such as a profile picture, from third-party sources where those parties have indicated that they have your consent or are otherwise legally permitted or required to disclose your personal information to us. For example, we may be provided with information about individuals interested in using our offerings, joining our company, or when using third-party authentication options to sign-up for or log-in to our offerings.

How We Use Your Personal Information

We use the information we collect (either ourselves or through third-party services), including personal information, that you provide to us or that is provided to us by third-party sources for a variety of purposes, including but not limited to the following purposes:

Business and Operational Purposes – We may use the personal information in order to run our business, including in the course of running and maintaining our Site and infrastructure; improving customer and user experience; providing support; improving current and developing new features, products, and services; processing payments and agreements; managing contests and promotions; analyzing trends; to achieve other legitimate interests as well as where you have provided consent; and other business and operational-related purposes.

Marketing and Commercial Purposes – We may use the personal information to send marketing and other communications to you; to conduct joint marketing efforts with our partners; to conduct digital and direct marketing; to connect you with our partners and resellers; and other marketing and commercial related-purposes.

Security Purposes – We may use the personal information to help ensure the security and integrity of our Site, our physical office location, and of our offerings; to help prevent fraud; to maintain endpoint and network security; and other security-related purposes. 

Legal and Compliance Purposes – We may use the personal information to comply with our legal obligations; protect our intellectual property; enforce our legal rights; and other legal and compliance-related purposes. 

What We Share

We may share personal information, including business contact information or aggregated demographic information regarding visitors and users of our Site with our affiliates, partners, sponsors, and advertisers as described in more detail below, consistent with the purposes previously outlined. This may be considered “sharing” or a “sale” under the CCPA. When we collect personal information through our offerings, it is made available to the Attaxion customer who was the source of the information and we use it as described in  the Privacy Policy, the terms and conditions, or otherwise as directed by our customers.

Social Media Features – Our Site may include social media features. These features may collect your IP address, which webpage you are visiting on our Websites, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing them.

Event Sponsors –  If you choose to register for or attend an Attaxion-hosted or jointly-hosted event or webinar or if you enter a contest or raffle with us and a sponsor, then we may disclose your contact information, content interest information or other activity data, and any other information, including personal information, collected in the course of these activities to those sponsors for commercial purposes. In many cases, you intentionally disclose your details by providing your information to these sponsors through consent via a registration form or by scanning your badge at the applicable sponsor’s booth. Virtual events hosted by third-party platforms may also collect additional data from you when you visit their sites. The treatment of this information is subject to each of these other entities’ respective privacy statements.

Partners and Resellers – We may disclose your personal information, such as contact information, business details, and content interest and activity details, to our partners and resellers for business purposes, such as to carry out our business or for joint marketing efforts to reach our customers and prospective customers. In many cases, you consent to the disclosure of your details by filling out a registration form. 

Referrals – Where we provide a referral option that you choose to use to share information with a point of contact about us, we will ask you for the contact’s name and email address. We will automatically send your contact a one-time email inviting him or her to visit our Website. Attaxion will store this information for the sole purpose of sending the one-time email and for tracking the success of our referral program. An individual whose name has been provided to us may contact us at [email protected] to request that we remove their information from our database.

With our Affiliates, Related to Corporate Transactions, the Provision of Professional Services, and Legal Disclosures – For all categories of data we collect, we disclose personal information to our affiliates and subsidiaries for business purposes, including any service providers and agents that work on our behalf. We may also disclose your information as required for us to carry out a corporate transaction, such as a merger or sale of assets of all or part of our company. We will also disclose your personal information to our professional service providers (for example, our auditors, insurance providers, financial service providers, and legal advisors) as needed for us to run our business, provide our offerings, support, maintain, or secure our offerings and our Websites; or administer activities on our behalf, such as events or marketing campaigns.We may also disclose your personal information as required by law, such as to comply with a subpoena or similar legal process; or when we believe that disclosure is necessary or appropriate to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

If we, or substantially all of our assets, are acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this policy.

We reserve the right to access, read, preserve and disclose any information about you if we reasonably believe it is necessary:

  1. to comply with any applicable law, regulation, governmental request or legal process, to establish or exercise our legal rights or defend against legal claims, or as may be required for the purposes of national security;
  2. to protect our rights or property, or to prevent physical, mental, financial or other harm, injury or loss to us, our users or the public;
  3. to detect, investigate, prevent, or otherwise address suspect or actual illegal or inappropriate activity or exposure to liability, including fraud, security or technical issues (which includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention);
  4. to enforce this privacy policy and our Terms of Service and any other agreements between us, including investigation of potential violations of the same, or
  5. to respond to user support requests.

We reserve the right, solely at our discretion, to object to certain information disclosure requests that we believe to be improper.

California Privacy Right: Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. EU Residents

If you are located in the European Union (“EU”), United Kingdom, Lichtenstein, Switzerland, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data (as defined in the GDPR). We are the controller of your Personal Data except where we process Personal Data of our customers’ end users and employees in connection with our provision of services to these customers, making us the processor of such Personal Data and those customers the controllers of the Personal Data. Where we are a controller of Personal Data, you have certain rights with respect to your Personal Data, including those set forth below. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  1. Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data. You can also access certain of your Personal Data by emailing us at [email protected].
  2. Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. Erasure: You can request that we erase some or all of your Personal Data from our systems.
  3. Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  4. Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  5. Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.
  6. Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
  7. Right to File Complaint: You have the right to lodge a complaint about our practices with respect to your Personal Data with the supervisory authority of your country or EU Member State.

Attaxion responds to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. When contacting us, please provide us with detailed information about the personal information you are requesting we correct, update, amend, or remove, and the timeframe and manner in which you believe we came to collect your personal information. If we obtained your personal information from a customer or third party acting on your behalf, you should contact the company or person you provided your information to. If you would no longer like to be contacted by one of our customers or would like to have your personal information corrected, updated, amended, or removed, please contact the customer/data controller that you interact with directly.

California Residents

The California Consumer Protection Act (“CCPA”) provides consumers (California residents) with specific rights regarding the processing of their personal information.

Categories of Personal Information Collected

In the preceding 12 months, Attaxion has collected the following categories of personal information about California consumers. We may collect this personal information directly from you, from third parties, and from your interactions with our Site. As defined by CCPA, the personal information categories are: 

  • business contact information, including identifiers such a name, email address, address, and phone number;
  • commercial information, such as records of products or services purchased and other transactional data;
  • Internet or other network or device activity details, such as technical data about your use of our Site;
  • geolocation data, such as your approximate location based on IP address;
  • audio, electronic, or visual data, such as part of a photo or recording for a Attaxion in-person or virtual event.

In regard to personal information provided by you, from third parties, or from your interactions with our Site, we may retain personal information for as long as is needed for the purpose(s) for which it was collected and no longer than is relevant and reasonably necessary. Our retention periods vary based on business, legal and regulatory needs. 

Purposes for Collection

Attaxion may collect the categories of personal information described above for business and operational purposes, marketing and commercial purposes, security purposes, and legal and compliance purposes. In the preceding 12 months and where applicable, we have disclosed each of these categories to our service providers, affiliates, partners, resellers, and event sponsors, in line with the applicable purpose(s).

Sensitive Personal Information

In the preceding 12 months, Attaxion has not collected, shared, or sold any sensitive personal information as described in the CCPA. 

Your Rights

  • You have the right to know what personal information we collect, use, disclose, share and sell about you.
  • You have the right to request we correct personal information we collect and maintain about you if such personal information is inaccurate.
  • You have the right to request we delete personal information we collect and maintain about you.
  • You have the right to opt-out of the sale or sharing of your personal data. Attaxion shares personal data as described above, which may be considered a “sale” of personal data under the CPRA. 
  • You have the right to limit the use or disclosure of your sensitive personal data. Attaxion does not collect, share, or sell sensitive personal data.
  • You have the right not to receive discriminatory treatment from Attaxion for exercising your privacy rights under the CCPA.
  • You have the right to designate an Authorized Agent to make a request on your behalf when exercising your privacy rights under the CCPA

If we obtained your personal information from a customer or third party acting on your behalf, you should contact the company or person you provided your information to. If you would no longer like to be contacted by one of our customers or would like to have your personal information corrected, updated, amended, or removed, please contact the customer/business that you interact with directly.

In the preceding 12 months, Attaxion has received 0 verifiable request from California consumers.

Information Security

The security of customer data and your personal information is important to us. We adopt data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure and destruction of customer data and your personal information. 

We seek to protect Account information to ensure that it is kept private; however, we cannot guarantee the security of any Account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. We otherwise store all of our information, including your IP address information, using industry-standard techniques. We follow generally accepted practices to protect customer data and the personal information collected and submitted to us, both during transmission and once we receive it. We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, Personal Information or otherwise.

Retention of Personal Information

We will retain your personal information for as long as needed to fulfill the purpose for which we collected it and for a reasonable period thereafter in order to comply with audit, contractual, or legal requirements, or where we have a legitimate interest in doing so. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may retain aggregated or de-identified data indefinitely or to the extent allowed by applicable law. We may retain personal information preserved in automatically generated computer back up or archival copies generated in the ordinary course of our information technology systems procedures.

Changes to Our Privacy Policy

We may need to revise our privacy policy from time to time. If we make changes, we will post the most-up-to-date version at https://attaxion.com/privacy-policy/ To facilitate easier review, we will update the policy version and effective date on that page. If we make major changes, we will notify registered users by email. Your continued use of Attaxion after the effective date of such changes constitutes your acceptance of such changes.
